Texas temporary insurance license explained
A Texas temporary insurance license lasts 180 days and needs no exam, but it comes with training, commission and replacement limits. Here is how it works.
Texas lets some insurance applicants start working before they pass the licensing exam, using a temporary license. It is a real option, but it is tightly restricted, and the exam questions on it are specific. Everything here comes from Texas Insurance Code 4001.151-.162 and the Pearson VUE candidate handbook (#124400).
What it is
A temporary license is for an applicant being considered for appointment by an agent, insurer or HMO. No exam is required to get it. If TDI has not denied the application by the 8th day after filing and you have not been notified, the applicant may act as an agent.
How long it lasts
It is valid for 180 days. Per the handbook, it cannot be renewed, and the exam must be passed within those 180 days. A temporary licensee also cannot get additional appointments.
What you cannot do
The restrictions are the heart of this topic:
- No commission on certain sales. You cannot earn commission on sales to family, to your employer or its employees (within the past 6 months), or to yourself.
- No replacements. A temporary licensee may not do any replacement of existing life insurance or annuities, including borrowing over 25% of loan value to fund a new policy.
What the sponsor must provide
The sponsoring agent, insurer or HMO carries obligations:
- At least 40 hours of training within 30 days of filing, with at least 10 of those hours in a classroom.
- Over any two consecutive quarters, at least 70% of temporary applicants must take the exam and at least 50% of those must pass.
- A sponsor may have at most 500 temporary license holders per calendar year, unless the commissioner's rules allow more.
The P&C exam uses the same 180-day, 40-hour framework, and a temporary license also requires the sponsor to file the proper form with TDI.
Does the training count for continuing education?
No. Continuing education credit is not given for courses taken before the license is issued, including under a temporary license.
Is a temporary license worth it?
It lets you start earning experience while you study, but the limits on who you can sell to and on replacements are real, and 180 days is a hard stop.
